RE: Extension of Part 3 of the Health (Preservation and Protection and Other Emergency Measures in the Public Interest Act) 2020 (hereinafter referred to as the “Act”)- Dear President Higgins, As you are aware, this week, the Health and Criminal Justice (COVID-19) (Amendment) Bill 2021, was successfully forced through both Houses of the Oireachtas, with Section 1 of the legislation, seeking to extend the duration of Part 3 of the Act. This letter is being written, to you, and copied to all members of the Irish Parliamentary system; to oppose the above extension outright.
We hereby request you not to sign The Health and Criminal Justice (Amendment) Bill 2021. The legislation, completely undermines our collective Constitutional protections. Therefore, we, as a people, reject any such decision; while requesting due reverence, for the sacrosanct separation of powers doctrine, you are yourself oath-bound to protect. The Irish State’s, fear and favour, shown to certain corporations, flies in the face of our fundamental rights, so we now instruct you Mister President, under Article 12 of the Irish ( Democratic Republic ) Constitution; to instead protect and ensure rule of law prevails.
Moreover, where Constitutional protection does not suffice, our courts may turn, to relevant EU and ECHR law; for guidance. Ireland remains a Democratic Republic, and all organs of The State, must function accordingly. However, all organs of the State seem somehow unaware, or in denial, of the true suffering of the Irish people. This suffering, includes that of the elderly, the disabled, the very vulnerable, and of children. The Irish people will not stand for such persecution, even, and especially, when it is posing as protection.
There are immediate ways, to protect citizens, from further despair and oppressive State sanctions, which are now restricting movement, the right to earn a livelihood, and denying countless other Constitutional rights. Including those that are imprescriptible, and ensured by case precedent. We hereby instruct you, to convene a meeting of the Council of State, in this regard. Furthermore, we insist, that you ensure the Separation Of Powers Doctrine, masterfully created by our forefather-drafters of the Irish Constitution, is respected. You must refer this wrongful legislation, to the Irish Courts, for appraisal and scrutiny.
To include full proportionality testing, in relation to the draconian oppressive lockdown measures, that now have the Irish people in a mental, physical and spiritual strangle-hold. We the people, hereby give notice, that as citizens of a Republic, we will invoke our collective right, to hold all parties, involved in such measures, responsible, for any related offences against us. Individually or collectively. Fatal or non-fatal. We hereby pronounce, that all public representatives, who directly or indirectly effect such harm, will be held accountable by the Irish people. This letter is to be treated as due notice. Neither our Government, nor media, have helped matters, with constant misinformation, fear-mongering, and other evidently divisive methods.
Only when our parliament and judiciary, properly reflect the unacceptable plight of distressed, oppressed citizens, can our Head of State inevitably represent the will of the people. Our Government, has now endorsed moral and legal hazards, by placing importance on corporate needs, over and above human rights. We do not agree to Mr. Stephen Donnelly representing us, in relation to this legislation, and we demand, that he ceases from being instructed, by the unelected body NPHET, immediately. The Irish legal system, provides no recourse through class actions, which also weakens any collective approach, to invoking Constitutional rights; leaving Irish citizens completely dependent on, and vulnerable to bad legal process. Therefore you are duty bound, and morally bound, to represent our wishes and opinions; in relation to Covid19 ’emergency powers’. The same system, that our forefathers ensured for our protection, is now, increasingly, acting only, on behalf, of our rulers. The invisible hand, controlling a land, that is, in fact owned, by none; but a universal creator.
Please note, that we now draw particular attention to The Right to Fair Trial, outlined in ECHR Article 6. We the People, will have no choice, but to invoke that right, should you as, our elected President, not represent our collective will. It is unacceptable that your office, continues to enable Human Rights violations, by signing off on legislation, that induces harm to the people. We will be following up this letter, with full details as to those violations; soonest. History has proved the resilience of the Irish people and our innate ability, to rise from the ashes. And, please be assured Mr President, that our dead heroes, stand firmly by our side.
Most certainly they do not stand, on the side of the Corporations, our State appeases, without the sanction of the Republic of Ireland. I.e. The People of Ireland.
